These Terms of Service ("Terms", "Agreement") govern your use of the website and services provided by StatTracker.live ("Company", "we", "us", or "our"), a service operated for users located in Canada and globally. By accessing or using StatTracker.live (the "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service.
This Agreement is a legally binding contract between you ("User", "you") and StatTracker.live. It includes important provisions regarding your rights, obligations, and limitations on liability. Please read carefully.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you represent and warrant that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (which is incorporated by reference). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.
2. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will become effective upon posting to the Service. Your continued use of the Service after any modification constitutes acceptance of the new Terms. We will notify you of material changes via email or a prominent notice on the Service at least 30 days prior to the effective date. If you do not agree to the modified Terms, you must stop using the Service.
3. Description of Service
StatTracker.live provides a platform for users to track, analyze, and visualize statistical data across various domains, including but not limited to sports, health, finance, and personal metrics. The Service includes data collection, storage, reporting, and sharing features. We do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service, which may be derived from third-party sources or user submissions.
4. User Accounts and Registration
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update it promptly. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts if we suspect breach of security or violation of law.
5. User Obligations and Prohibited Conduct
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including Canadian federal and provincial regulations. You must not:
- Violate any law, regulation, or third-party rights;
- Upload or transmit viruses, malware, or harmful code;
- Attempt to gain unauthorized access to our systems or user accounts;
- Use the Service for spam, phishing, or fraud;
- Harvest or collect user data without consent;
- Interfere with the operation of the Service, including through automated means (e.g., bots, scrapers);
- Post content that is defamatory, obscene, or violates Canadian hate speech laws.
6. Intellectual Property Rights
The Service, including its design, code, graphics, logos, and content (excluding User Content), is owned by StatTracker.live or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a non-exclusive, non-transferable, limited license to use the Service for personal or internal business purposes. You may not copy, modify, reverse engineer, or create derivative works without our prior written consent.
7. User Content
You retain ownership of any data, statistics, or content you submit or upload to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, reproduce, process, and display such content solely for the purpose of providing and improving the Service. You represent that you have all necessary rights to grant this license and that your content does not infringe third-party rights or violate law. We reserve the right to remove User Content that violates these Terms.
8. Privacy and Data Protection (GDPR Compliance)
We take data privacy seriously. Our practices comply with the General Data Protection Regulation (GDPR) for users in the European Economic Area, as well as Canadian privacy laws such as PIPEDA. Key provisions include:
- Lawful Basis: We process personal data based on consent, contractual necessity, legitimate interests, or legal obligations.
- Data Collected: We collect registration data (e.g., name, email), usage data (logs, IP address), and any data you provide (e.g., statistics).
- Purpose: Data is used to operate, improve, and personalize the Service, and to communicate with you.
- Your Rights: You have the right to access, rectify, delete, restrict, port, and object to processing of your data. You may withdraw consent at any time.
- Data Security: We implement appropriate technical and organizational measures, including encryption, to protect your data.
- International Transfers: Data may be stored on servers in Canada, the US, or other jurisdictions. For GDPR users, adequate safeguards (e.g., Standard Contractual Clauses) are in place.
- Data Retention: We retain data as long as your account is active or as needed to comply with legal obligations. You may request deletion.
- Cookies: We use essential and analytics cookies. You can manage preferences via cookie settings.

- Complaints: GDPR users may lodge a complaint with their local supervisory authority.
9. Third-Party Services and Links
The Service may contain links to third-party websites or services (e.g., payment processors, analytics tools). We are not responsible for their content or practices. Your interactions with third parties are solely between you and them, and are subject to their own terms and privacy policies.
10. Payment and Subscriptions
Certain features may be offered on a subscription basis ("Paid Services"). Fees are non-refundable except as required by Canadian consumer law. We may offer free trials; cancellation before the trial ends is your responsibility. Payments are processed securely by a third-party processor; we do not store full payment card details. We reserve the right to change fees with 30 days' notice. Failure to pay may result in suspension of access.
11. Termination
Either party may terminate this Agreement at any time. We may suspend or terminate your access immediately without prior notice if you violate these Terms or applicable law. Upon termination, your right to use the Service ceases, and we may delete your User Content within 30 days, subject to legal retention requirements. Sections 6, 8, 12, 13, 14, and 15 survive termination.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK. IN CANADA, CERTAIN STATUTORY WARRANTIES MAY APPLY UNDER THE COMPETITION ACT OR PROVINCIAL LAWS, BUT OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STATTRACKER.LIVE, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) LOSS OF PROFITS, DATA, USE, OR GOODWILL; (C) ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM. THIS LIMITATION DOES NOT APPLY TO LIABILITY FOR DEATH, PERSONAL INJURY, FRAUD, OR GROSS NEGLIGENCE.
14. Indemnification
You agree to indemnify, defend, and hold harmless StatTracker.live and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your infringement of any third-party rights. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Dispute Resolution: Any dispute arising out of or relating to this Agreement shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be finally settled by binding arbitration administered by the ADR Institute of Canada in accordance with its Arbitration Rules. The arbitration shall take place in Toronto, Ontario, and the language shall be English. Each party shall bear its own costs. Class actions and jury trials are waived. If arbitration is prohibited by law, the exclusive jurisdiction and venue shall be the courts of Toronto, Ontario.
16. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and StatTracker.live regarding the Service, superseding prior agreements or communications.
18. Waiver and Assignment
Our failure to enforce any right or provision of these Terms shall not constitute a waiver. We may assign our rights and obligations under these Terms without your consent, provided you are notified. You may not assign these Terms without our prior written consent.

20. Additional Provisions for GDPR Compliance
For users subject to GDPR (EEA residents), the following additional terms apply:
- Data processing is carried out in accordance with Article 6 GDPR. Consent, where required, is freely given and can be withdrawn at any time.
- You have the right to lodge a complaint with a data protection authority, particularly in the Member State of your habitual residence.
- International transfers are safeguarded via Standard Contractual Clauses (SCCs) or an adequacy decision.
- We have appointed a Data Protection Officer (DPO) reachable at dpo@stattracker.live.
- Automated decision-making, if any, will be disclosed, and you have the right to request human intervention.
- Data portability is available for data you provided, in a structured, commonly used format.
These GDPR provisions prevail over any conflicting term in this Agreement for EEA users.
